Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the EluriaMC Minecraft server, website, store, and related services (“Services”) operated by Ethobyte B.V. (“we,” “our,” or “us”), a company based in the Netherlands. By accessing or using our Services, you agree to these Terms. If you do not agree, you must not use our Services.

1) Eligibility

• You must be at least 13 years old to use our Services.
• If you are under 18, you must have parental or guardian permission.
• By using our Services, you confirm that you meet these requirements.

2) Rules of Conduct

You agree to:

• Follow all in‑game rules as published on our website or server.
• Respect other players and staff — no harassment, hate speech, or abusive behavior.
• Not use cheats, exploits, bots, or other unauthorized software.
• Not attempt to disrupt or damage the server, website, or related systems.
• Not impersonate staff or other players.

Enforcement: Violations may result in temporary or permanent bans without refund.

3) Purchases & Donations

• Purchases made through our Craftingstore store are considered donations that support server development and upkeep.
• All purchases are final. Refunds are generally not provided unless required by law.
• Virtual items and ranks have no real‑world monetary value and may not be exchanged or resold.
• We may modify or remove items, perks, or ranks as part of game balancing or updates.

4) Account Linking

• You may link your Discord and Minecraft accounts for rank syncing.
• You are responsible for keeping your accounts secure.
• We are not responsible for losses caused by unauthorized access to your linked accounts.

5) Staff Panel (Staff Members Only)

• Staff with panel access must keep login credentials secure.
• Staff actions may be logged (IP address, user agent, actions) for accountability and security.
• Misuse of staff access may result in removal and/or bans.

6) Community‑Generated Content

By submitting content (e.g., builds, screenshots, videos, posts, suggestions), you grant us a non‑exclusive, royalty‑free, worldwide license to use and display that content in connection with the Services and promotional materials. You retain ownership of your creations, but we may showcase them (website, social media, in‑game).
You may not submit content that infringes others’ rights, is illegal, or violates our rules. We may remove or refuse content at our discretion.

7) Availability of Services

We strive to keep EluriaMC online, but we cannot guarantee 100% uptime. Maintenance, updates, or technical issues may cause temporary disruptions. We are not liable for downtime, lost progress, or data corruption.

8) Intellectual Property

• EluriaMC is an unregistered trademark of Ethobyte B.V.
• Content on our website, server, and store (logos, branding, custom plugins) is the property of Ethobyte B.V. unless noted otherwise.
• Do not use our name, brand, or content without written permission.

9) Limitation of Liability

Our Services are provided “as is” and “as available.” To the maximum extent permitted by Dutch and EU law, we are not liable for:

• Lost progress, in‑game items, or ranks;
• Disruptions, downtime, or technical failures;
• Misuse of your account by others;
• Any indirect, incidental, or consequential damages.

10) Termination

We may suspend or terminate access at any time, with or without cause. You may stop using the Services at any time. Termination does not entitle you to a refund for past purchases.

11) Changes to Terms

We may update these Terms at any time. The latest version will be available on our website with the “Last Updated” date. Continued use after changes take effect means you accept the updated Terms.

12) Governing Law

These Terms are governed by the laws of the Netherlands and applicable EU regulations. Disputes are subject to the jurisdiction of Dutch courts.
